www.saptapadi.in Terms of Use / Service Agreement
Welcome to www.saptapadi.in, the No.1 Matrimonial Services Provider exclusively for Jain community.
In order to use the www.saptapadi.in Site (“Site”), you must register as a member of the Site (“Member”) and agree to be bound by these Terms of Use (“Agreement”). If you wish to become a Member and communicate with other Members and make use of the Www.saptapadi.in service (“Service”), read these Terms of Use and follow the instructions in the Registration process. This Agreement sets out the legally binding terms for your membership. www.saptapadi.in reserves the right to modify, suspend, or discontinue the Service, or any part of the Service, at any time and without notice (except as required by applicable law), and www.saptapadi.in will not be liable to you, should it exercise such rights, even if your ability to use its services are impacted by the change.
By becoming a member of www.saptapadi.in and/or using the Services of the Site, you unconditionally and irrevocably confirm that you have read the provisions and agree to abide by them.
Eligibility. To register as a member of www.saptapadi.in or use this Site, you must be of legal marriageable age as per the laws of India (currently, 18 years or over for females and 21 years or over for males). Membership in the Service is void where prohibited. By using this Site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.
Terms of Use by Members. You may terminate your membership at any time, for any reason by writing to Www.saptapadi.in. In the event you terminate your membership, you will not be entitled to a refund of any unutilized subscription fees. www.saptapadi.in may terminate your access to the Service, including any subscription available as part of the Service, at our discretion without notice (except as may be required by applicable law). however, if you violate any of the terms of this Agreement, your rights under this Agreement will automatically terminate without notice, and Www.saptapadi.in. may, in its discretion, immediately revoke your access to the Service and to its Content without refund of any fees. In such event, you must delete all copies of its Content that you have downloaded. If Www.saptapadi.in terminates your membership in the Www.saptapadi.in Service because you have breached the Agreement, you will not be entitled to any refund of any unused Subscription fees. Even after this Agreement is terminated, certain provisions will remain in effect of this Agreement.
The www.saptapadi.in Site is for the personal use of individual members only, and may not be used in connection with any commercial endeavours. This includes providing links to other web sites, whether deemed competitive to www.saptapadi.in or otherwise. Organizations, companies, and/or businesses may not become Members of www.saptapadi.in and should not use the Www.saptapadi.in Service or Site for any purpose. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.
www.saptapadi.in presumes that each and every single member / user / visitor, who logs on to the website has an intention to get married / enter into a matrimonial alliance and not otherwise. www.saptapadi.in under no circumstances shall be responsible for any loss or damage resulting from anyone’s use of the Site or the Service and / or any Content posted on the web Site or transmitted to users / Members. The exchange of matrimonial profile(s) through or by www.saptapadi.in should not in any way be construed as a matrimonial offer and/or recommendation from or by www.saptapadi.in. www.saptapadi.in shall not be responsible for any loss or damage to any individual arising in/out of, or subsequent to, matrimonial relations established pursuant to use of the service provided by www.saptapadi.in.
Any advice, counselling, recommendations or information provided at www.saptapadi.in including information of Www.saptapadi.in members may not be necessarily correct, true or reliable, and that any reliance placed thereon and any action taken on the basis thereof shall be entirely / solely at the risk of the person or persons placing such reliance or taking such action. Visitors wishing to use the information so provided are advised to conduct their own due diligence, in respect of the site content sought to be taken advantage of, at their own initiative, cost and effort. www.saptapadi.in does not advise / recommend its users / visitors to establish any contact / interaction with any other user / member / visitor or any such Profile(s) as displayed in the website based on the data / information as furnished in such users profile / photograph etc. and the user / visitor opting to build contact or interact shall do it solely at his / her own risk. www.saptapadi.in cannot be held responsible or liable, in any manner whatsoever, in respect of any reliance placed on any information displayed / placed on the website, since the same purports merely to act as indicators of the general scenario in the related behalf.
www.saptapadi.in does not authenticate, vet, screen, endorse or investigate any information or assertion comprised in the matrimonial listings, or any other content on the website, nor does it in any manner whatsoever certify or attest the same to be correct or true. It does not recommend matches and profiles in any manner, but an implied presumption is cast on the users / members that the information(s) furnished are exclusively / solely to curve out / frame a suitable profile for the purpose of matrimonial alliance and they are true and correct. All due diligence, effort and initiatives must be exercised by those wishing to use any information found on the website, and should take adequate precautions with the full and complete knowledge that all information contained in the matrimonial listings have been placed there directly by visitors to the website without any prior intimation, consent or verification of or by www.saptapadi.in.
Multiple profiles of the same person are not allowed on www.saptapadi.in. www.saptapadi.in reserves the right to deactivate all multiple profiles without any refund of subscription fees. You may not engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You will not transmit any chain letters or junk e-mail to other www.saptapadi.in Members. Although www.saptapadi.in cannot monitor the conduct of its Members off the www.saptapadi.in Site, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect www.saptapadi.in and/or our Members from any abuse / misuse, Www.saptapadi.in reserves the right to restrict the number of communications / profile contacts & responses / e-mail which a Member may send to other Member which Www.saptapadi.in deems appropriate in its sole discretion.
You may not use any automated processes, including IRC Bots, EXE’s, CGI or any other programs/scripts to view content on or communicate / contact / respond / interact with www.saptapadi.in and/or its members.
Proprietary Rights in Content on www.saptapadi.in. www.saptapadi.in owns and retains other proprietary rights in the Www.saptapadi.in Site and the Www.saptapadi.in Service. The Site contains the copyrighted material, trademarks, and other proprietary information of www.saptapadi.in, and its licensors. Except for that information which is in the public domain or for which you have been given permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
Www.saptapadi.in Site may, in our sole discretion, terminate or suspend your access to all or part of the Website at any time, with or without notice, for any reason, including, without limitation, breach of this Agreement. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your access to all or part of the Website at our sole discretion, and you may be referred to appropriate law enforcement agencies.
Content Posted on the Site. You understand and agree that www.saptapadi.in may delete any content, messages, photos or profiles (collectively, “Content”) that in the sole judgment of Www.saptapadi.in violate the Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of other www.saptapadi.in and/or its Members.
You are solely responsible for the Content that you publish or display (hereinafter, “post”) on the www.saptapadi.in service, or transmit to other www.saptapadi.in Members. www.saptapadi.in reserves the right to verify the authenticity of Content posted on the site. In exercising this right, Www.saptapadi.in may ask you to provide any documentary or other form of evidence supporting the Content you post on the site. If you fail to produce such evidence, Www.saptapadi.in may, in its sole discretion, terminate your Membership without a refund.
You must use the Www.saptapadi.in Service in a manner consistent with any and all applicable local, state, and federal laws and regulations.
Copyright Policy. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Www.saptapadi.in service in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that your claim has been infringed; a description of where the material that your claim is infringing is located on the our Site; your address, telephone number, and e-mail address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. www.saptapadi.in’s Copyright Agent for Notice of claims of copyright infringement can be reached by writing to the Mumbai address located under the Help/Contact section on the site. www.saptapadi.in reserves the right to proceed/initiate appropriate steps under the prevailing law against infringement by violators of the its proprietary rights or for illegally copying, modifying, publishing, transmitting, distributing, performing, displaying, or selling of any such proprietary information including using it for commercial purpose in any manner whatsoever.
You acknowledge that you are responsible for the content (mandatory or optional content you provided on our website) and information including the profile details, photograph and other content(s) keyed in the relevant field of the Website at the time of the creation of the www.saptapadi.in profile or subsequently modified by you and also for all the post and communication (including personalized messages sent by www.saptapadi.in paid members) with other member(s). You hereby represent and warrant that you own all rights, title and interest in your content/information or have the necessary licenses, rights, consents, and permissions to provide the said content/information. However, by submitting the content/information to www.saptapadi.in, you hereby grant www.saptapadi.in a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, publish, communicate to the public, law enforcement agencies, courts, and the www.saptapadi.in's business and services, including without limitation for promoting, communicating to the public and redistributing part or all of the content/information (and derivative works thereof) in any media formats and through any media channels. www.saptapadi.in also reserves the right to block the registration of your profile on Website, if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in data entered by the www.saptapadi.in members in their profile. While www.saptapadi.in does not accept any obligation to monitor the content/information, if the content/information is found not to be in compliance with these Terms, then www.saptapadi.in may delete the content/information and / or terminate or suspend your registration or (without a refund of any subscription paid by you as per these terms and conditions). You agree that if the situation warrants www.saptapadi.in may at its sole discretion put restriction on any www.saptapadi.in member to other member’s communications. www.saptapadi.in reserves the right to suspend/delete the profile of the users who appropriate the name, likeness, email address, contact no or other personally identifiable information of another individual and www.saptapadi.in also reserves its right to initiate appropriate legal action against such individual/organization, as and when www.saptapadi.in get the knowledge of the same.
In the event we get a complaint against you and consequently we have suspended/deleted your profile in good faith, then we shall not be liable to you in any manner whatsoever, including for any loss, costs, expenses, or consequence, if any.
Member Disputes. You and the prospect are both registered www.saptapadi.in members and are bound by these terms and condition. www.saptapadi.in is not a broker or the agent of any www.saptapadi.in members, and www.saptapadi.in does not partake in the exchange of any kind of discussion between the www.saptapadi.in members and prospects or the results of their discussion. www.saptapadi.in Member's are solely responsible for the communications (through any medium) with prospect or vice versa. www.saptapadi.in expressly disclaims any responsibility or liability for any transaction(s) or exchange(s) or interaction(s) or passing of information(s) etc. between any www.saptapadi.in members inter se via e-mail, chat, interaction or any other medium of communication between www.saptapadi.in members either using website /App or otherwise. www.saptapadi.in has no obligation, to monitor any such disputes arising between the www.saptapadi.in members, and www.saptapadi.in shall not be party to any such dispute/litigation etc. You are solely responsible for your interactions with other www.saptapadi.in Members. www.saptapadi.in reserves the right, but has no obligation, to monitor disputes between you and other Members. www.saptapadi.in also reserves the right to take appropriate action against errant members. However, www.saptapadi.in is not obliged to share such action with other members, including complainants.
Privacy. Use of the www.saptapadi.in Site and/or the www.saptapadi.in Service is governed by our Privacy Policy.
Disclaimers. www.saptapadi.in is not responsible for any incorrect or inaccurate Content posted on the Site or in connection with the www.saptapadi.in Service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized neither in the Service, nor for the conduct of any User and/or Member of the www.saptapadi.in Service whether online or offline. www.saptapadi.in assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User and/or Member communications. Www.saptapadi.in is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to Users and/or Members or to any other person’s computer related to or resulting from participating or downloading materials in connection with the www.saptapadi.in Site and/or in connection with the www.saptapadi.in Service. Under no circumstances will www.saptapadi.in be responsible for any loss or damage resulting from anyone’s use of the Site or the Service and/or any Content posted on the Www.saptapadi.in Site or transmitted to www.saptapadi.in Members. The exchange of matrimonial profile(s) through or by “www.saptapadi.in” should not in any way be construed as any matrimonial offer and/or recommendation from/by www.saptapadi.in. www.saptapadi.in shall not be responsible for any loss or damage to any individual arising out of, or subsequent to, matrimonial relations established pursuant to the use of Www.saptapadi.in. The Site and the Service are provided “AS-IS” and www.saptapadi.in expressly disclaims any warranty of fitness for a particular purpose or non-infringement. www.saptapadi.in cannot guarantee and does not promise any specific results from use of the Site and/or the www.saptapadi.in Service.
Limitation on Liability. Except in jurisdictions where such provisions are restricted, in no event will www.saptapadi.in be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the Www.saptapadi.in Service, even if www.saptapadi.in has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, www.saptapadi.in, liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to www.saptapadi.in, for the Service during the term of membership. www.saptapadi.in does not warrant that the Service will be uninterrupted or error-free. www.saptapadi.in provides the service on an “as is” basis. However, www.saptapadi.in will take all reasonable steps to provide its users with error free, uninterrupted user experience. There may be delays, omissions, and interruptions in the availability of the Service. The user/member acknowledges that use of the Service is solely at their cost and risk. www.saptapadi.in is not responsible for suspension of the Service, irrespective of the reason for such interruption / suspension. Www.saptapadi.in Site cannot ensure the security or privacy of information you provide through the Internet and your email messages, and you release us from any and all liability in connection with the use of such information by other parties; We are not responsible for, and cannot control, the use by others of any information which you provide to them and you should use caution in selecting the personal information you provide to others through the Website. Www.saptapadi.in Site cannot assume any responsibility for the content of messages sent by other users of the Website, and you release us from any and all liability in connection with the contents of any communications you may receive from other users. You acknowledge that you cannot sue Www.saptapadi.in Site or any of its employees for any damages done to you through the site. Www.saptapadi.in Site cannot guarantee, and assume no responsibility for verifying, the accuracy of the information provided by other users of the Website. You may not use the Website for any unlawful purpose.
Payment. If you purchase a subscription or start a free trial for a subscription, your subscription will automatically continue, and you authorize us (without further notice, unless required by applicable law) to collect the then-applicable periodic subscription fee including any taxes, using any payment method we have on file for you..after your online payment for the type of subscription you have used you will have to wait for 24 hrs to get your services activated by Www.saptapadi.in as the payment processed by you will be verified and then approved.
Disputes. If there is any dispute about or involving the Site and/or the Service, by using the Site, you agree that the dispute will be governed by the laws of the State of Maharashtra, India without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and central courts of the Mumbai, India. a
Indemnity. You agree to indemnify and hold www.saptapadi.in, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above. By using our www.saptapadi.in services you agree to defend, indemnify, and hold harmless www.saptapadi.in, its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person through improper use of the service provided by www.saptapadi.in. This defence and indemnification obligation will survive in perpetuity.
Other. By becoming a Member of the www.saptapadi.in service, you agree to receive certain specific e-mail from www.saptapadi.in.
This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the www.saptapadi.in service, contains the entire agreement between you and Www.saptapadi.in regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
By joining www.saptapadi.in, you confirm that you have read the above provisions and agree to abide by them.
